The Transfer Disclosure Statement

Which we refer to as the TDS is the statement that informs the Buyer of ANYTHING that might effect the value of the property. I had a senior agent at another brokerage tell me he sold a house and after the buyers moved in they were finding beer cans on their back lawn on Saturday mornings. It turns out that some teenagers habitually parked in the culdesac and drank beer on Friday nights and would toss their empties over the wall. So, the new buyer asks his neighbor ” whats the deal with all the beer cans on the lawn?” to which the neighbor replies “didn’t he tell you?” The buyer went back and read his TDS and didn’t see any reference to the problem. The matter was settled out of court; the sellers paid the buyer $20,000.00.

READ THE TDS CAREFULLY AND FULLY DISCLOSE ANYTHING THAT MIGHT EFFECT THE VALUE OF THE PROPERTY.
